When a medicine is used in an off-label or off-patent setting, it falls outside the usual pathway for drug approval via the Scottish Medicines Consortium (SMC) – the equivalent of National Institute for Health and Care Excellence (NICE) in England. This can create a gap in enabling reconsideration of a cancer drug to be used in a slightly different way, for example, earlier in the treatment pathway now that the drug is cheaper as it is off-patent.
